HIPAA defines “marketing” as a communication that encourages its recipient to purchase or use a product or service.
If HIPAA applies to you as a Business Associate rather than a Covered Entity you have to check your contracts (aka Business Associate Agreements) to see what they say about using protected health information for marketing. We suggest you CONSULT YOUR LAWYER for that.
Now the Good News…..
Here’s the thing about those HIPPA marketing restrictions, they DON’T APPLY until after you’ve already converted a prospect to a patient. Obviously, that means new lead generation, and the activities needed to actually convert a new lead to a customer that very first time, are outside the scope of your HIPAA obligations.
And NOW for the REALLY Good News…..

On the other hand, if you converted a customer for a HIPAA covered product or service, whether and how you can market to that type of converted customer (whether through ClickFunnels or any other means) needs to be addressed by looking to the overall HIPAA program your lawyer already set up for you. You have a lawyer and a HIPAA program, right? RIGHT?!
